On June 1998, I was diagnosed with rheumatoid arthritis that progressively worsened until I was physically unable to work in any type of capacity in 2007. Following this, based on my research findings that prolonged exposure to silica dust is well known to cause rheumatoid arthritis, I made a claim for WSIB benefits as I was continuously exposed to silica dust as an autobody mechanic from 1971 to 2007. Although the WSIB accepted that I was occupationally exposed to silica dust, the WSIB maintained that I did not meet the occupational exposure threshold required for entitlement.
Initially, I sought legal help with my appeal from several legal representatives, but no one took on my case as they said I did not have any merit with my appeal and agreed with the WSIB’s decision.
Mr. Bruce Zevallos was the only one to say I had a case and I hired him to start the groundwork to seek and obtain the evidence required to win my appeal. Mr. Zevallos presented my appeal to an Appeals Resolution Officer and obtained a successful conclusion with securing initial entitlement to rheumatoid arthritis and full loss of earning benefits to age 65.
